Zaostritev EU zakonodaje o orožju

Upam, da se ZZB oglasi in nas podpre...saj menda vedo, kaj se dogaja ali pač ne?

Ta trenutek zakonodaja še ni v obravnavi v Parlamentu, ko pa bo, se bom vsekakor posvetil vsebini in podprl le tiste dele, ki so smiselni in ne populistični.
 
Menim, da mora biti prodaja kakršnegakoli orožja strogo nadzorovana, še posebej ko gre za spletno prodajo. Prav je, da imamo stroga pravila glede deaktiviranega orožja in da pri vprašanju orožja države članice sodelujejo med seboj.  Prav je tudi, da imajo pristojne institucije nadzor nad delovanjem legalnih prodajalcev orožja. Na teh točkah je predlog Evropske komisije korekten.
 
Žal pa je v nekaterih pogledih Evropska komisija odreagirala populistično in se je osredotočila na regulacijo legalno pridobljenega orožja, medtem ko za naslovitev resničnega problema, torej ilegalnega orožja v EU, še ni dala zakonodajnega predloga.
 
V priponki najdete poslansko vprašanje, ki sem ga naslovil na Evropsko komisijo in kjer prosim za pojasnilo zgoraj omenjenega.

Nič se ne bi zgodilo in nič ne bi pomagalo, saj bo slovenska vlada/parlament morala uskladiti (sprejeto) direktivo v ZORO.

Pa še vprašanja EU poslanca Zvera, ki jih je poslal na Komisijo:

Evropska komisija je 18.11.2015 pripravila Predlog spremembe Direktive 91/477/EEC, s katerim naj bi omejila ilegalno preprodajo in uporabo orožja, preprečila dostop do njega ter harmonizirala zakonodajo držav članic in okrepila sodelovanje.
Popolnoma se strinjam s Komisijo, da je potrebno preprečiti ilegalno prodajo orožja in njegovo uporabo za teroristične namene. Vendar Predlog prinaša nekatere dileme, na katere nas je opozorila zainteresirana javnost. 

Tako je po novem onemogočeno razpolaganje s polavtomatskim orožjem, ki je podobno avtomatskemu strelnemu orožju vsem fizičnim osebam brez izjem. Ukrepi se tako nanašajo tudi na lastnike legalno pridobljenega polavtomatskega orožja, ki ga uporabljajo za športno udejstvovanje in lov (ki ob uveljavitvi omenjenih sprememb Direktive teh dejavnosti ne bodo mogli opravljati), ne zadevajo pa zmanjševanja preprodaje orožja na črnem trgu. 

Raziskave in poročila pa kažejo, da se večina kaznivih dejanj in dejanj terorizma zgodi z nelegalno pridobljenim orožjem, zelo malo pa z legalno pridobljenim.

Zato sprašujem EK:
1) kakšen odstotek kaznivih dejanj je storjenih z legalno pridobljenim orožjem, na zmanjšanje katerih namerava vplivati s Predlogom spremembe Direktive  91/477/EEC?
2) zakaj je objavila Predlog, ki se nanaša na legalno pridobljeno orožje, veliko prej,  kot namerava objaviti akcijski program za boj proti ilegalni trgovini z orožjem?
3) ali Komisija ne meni, da bi zaostritev legalnega procesa dostopa do orožja še povečala trgovanje z orožjem na črnem trgu?

"Within this context it is of major interest to understand the scale of criminal offences involving legally held firearms, as directly regulated by the Firearms Directive. A recent UNODC study argues that “the majority of civilian firearms are not misused and are owned for legitimate purposes”. The significant difference between global estimates on the number of civilian firearms owned (hundreds of millions) and annual firearm homicides (around 199,000 in 2010) supports this conclusion.72 Nonetheless, data reported by national Police Departments and Ministries of the Interior throughout the study, and cases described in secondary sources, also point at episodes of misuse of legally owned firearms."

"In Finland73, there are annually about 20-30 cases of homicides committed with firearms, in less than 10 cases was the firearm legal.
The UK reports that legally held firearms are “rarely” used in crime74 whereas Slovenia75 reports no offences by legally held firearms.
In Portugal76, between 95-98% of weapons used in crime77 are civilian firearms, either legally owned or legally owned but stolen and/or converted.
In the Czech Republic78 in 2013, of the identified weapons used in crime, legal firearms were used almost four times as often as illegal weapons (182 compared to 47), the majority being category D weapons (135 cases). In addition, the Czech Republic also reported 132 cases where the firearm was never identified.
Similarly, in Romania 79 licit ownership of firearms in 2013 was reported in 160 cases while illicit ownership in 44, illicit trafficking in 101 and homicides in 8 cases.
Between 1991 and 2014, Malta80 had 57 homicides involving civilian firearms: out of the 39 solved cases, the majority referred to legally owned firearms.
In the Netherlands, the National Police reported that a very low number of crimes is committed with legally owned firearms, but the most shocking incident 81 (6 people killed, 17 injured) was committed with two legally owned firearms.
In Germany82, considering only the number of weapons seized on crime scenes, weapons requiring a license represented around 30% of all firearms in 2013, and approximately 5% of them were legally owned.
In Sweden83 most of the reported crimes (i.e. murder, manslaughter. and armed bank robbery) occurred between 2000 and 2010 involving weapons and that went to prosecution were committed with illegally held firearms84 In Luxembourg the Police Grand-Ducale
reported that all firearms used in homicides where illegally held."

The police described the trafficking as ’ant trafficking’, small scale smuggling, which is mainly sourced from the Western Balkans. 90 In August 2014, customs in Malmö, Sweden, confiscated seven pistols posted from different EU MS, including from Czech Republic, Germany and Slovakia, produced by Walther (Germany), Glock (Austria) and Zastava Arms (Serbia).91"

weapon is kept in a family without the proper authorisations94"

V glavnem, do sedaj so le priznali, da po drzavah prihaja do razlik med orozjem uporabljenim v ubojih, po nekaterih drzavah je procent legalnega prozja vecji, pri drugih manjsi, kar ocitno kaze na to, da je incidenca ubojev stalnica, dogaja pa se pac s tistim orozjem/orodjem, ki je v tistem trenutku dosegljivo. Ce je dosegljivo legalno orozje, bo uporabljeno legalno, ce legalnega orozja ni, bo uporabljeno ilegalno orozje.

V nobeni od nastetih statistik, ni opredeljena kategorija orozja. Govori se o orozju.
Ne povedo, ali je orozje B1 kategorije (kar zelo verjetno je) ali katere druge kategorije je. V nekaterih primerih so orozja predelana.

Skratka, z direktivo so se spravili na B7 in potencialno na B4 kategorijo, ki v njihovih statistikah nikjer ni omenjena kot problematicna.

Skratka, veliko ukrepov proti polavtomatskemu orozju, hkrati pa priznavajo, da nimajo podatkov, ki bi kazali, da bi legalno polavtomatsko orozje bilo predelano na avtomatsko in uporabljeno v kriminalnih dejanjih. Hkrati operirajo s podatki, ki jasno kazejo, da legalno orozje v vecini drzav clanic ne predstavlja tistega orozja, ki bi se uporabljalo za kriminal, in v tem orozju so vstete vse kategorije orozja, medtem pa se spravljajo na B7 in "puske podobne avtomatskim".

Kar se tiče orožja kategorije A so vojaška in polcijska skladiča praktično edini vir ,pa naj bo to 2mio AK47, ki jih je izginilo iz depojev v Albaniji , ali kak Mio kom iz ex-Juge k temu lahko dodamo še 4+mio kosov, ki so se zdaj v Ukrajini porazgubili ,pa kose, ki so iz depojev zginili po padcu Sovjetske zveze po vseh državah vzhodnega bloka.Pa orožje ki se je na veliko stekalo na Kosovo v času vojne etc lista je zelo dolga

Nekatera so ukradena po večkrat ,primer orožja , ki ga je čisto vrjetno prodajala 'slovenska kriminalna združba'(ve se katera) v 90letih to je bilo kupljeno na črno(po domaču ukradeno iz vojaških depojev) v Ukrajini  ladjo, ki je peljala v Koper so 94' prestrgli Italjani ,orožje so skladiščili na Sardiniji ,2011 pa je nenadoma izginilo iz depojev(z uradno pomočjo ali ne?) 400 Kom Maljutk ,Fagot ,50 lanserjev, 30,000 AK47s; 5,000 raket RPG etc ,11,000  raket za večcevne lanserje  in še cca 32 millionov nabojev. Pa to je bila samo ena pošiljka ki so jo prstregl pred dobavo.

Prometna politika zmanjševanja prometnih nesreč za leto 2020.

Namen je najučinkoviteje zmanjšati prometne nesreče

Vinjenih povzročiteljev nesreč je 5%, zato predlagamo, da se vozniško dovoljenje odvzame 95% treznih voznikov, ki ogrožajo prometno varnost.

Ps: Bruseljski birokrati lahko nakažejo denar za avtorsko delo, najbližji gostilni, ki skrbi za varne pijane voznike.

Očitno pa je tudi avtor zaskrbljen, da bo prepovedano polavtomatsko orožje v celoti.

Najboljše vprašanje za EK: ok, prepovedali boste polavtomatsko orožje, ampak kaj boste storili pa potem, ko se bo zgodil nov masaker, seveda z ilegalnim orožjem?

Opazili bodo, da ukrepi niso bili dovolj strogi, pa bodo vrlim državljanom pobrali še vse zračke, frače, nože (ki so podobni vojaškim nožem), sekire, motike....
